MONTPELIER, Vt. (AP) - A lawyer for a convicted sex offender has asked a Vermont judge to make a final ruling in the man's battle against the city of Barre, which told him to move.
The Barre-Montpelier Times-Argus reports Christopher Hagan sued the city in May, arguing that it didn't have the authority to pass an ordinance that prevents sex offenders from living within 1,000 feet of schools and recreation areas. The city agreed to stay enforcement for two months or until a court rules on Hagan's motion for a preliminary injunction in the suit brought by the American Civil Liberties Union.
Hagan was accused in 2001 of sexual assault as a result of what he claimed was consensual sex with a 15-year-old. Hagan, then 18, pleaded guilty to a lesser charge.
