Police: Drunk Driver Caused Fatal Crash in Bennington

Bennington, Vermont - July 24, 2009

Police say a fatal car crash in Bennington was caused by a drunk driver who was three times over the legal limit.

Fifty-seven-year-old John Thomayer, of Bennington, was killed in the head-on collision on West Road on May 29. The other driver, 54-year-old Peter Rubin, of Old Bennington, suffered severe injuries before being pulled from his burning car by rescue teams. Now toxicology reports show Thomayer's blood alcohol content was over three times the legal limit of .08 when he crossed the center line and hit Rubin head-on.
