Should Unborn Babies be Considered Humans in Court?

Montpelier, Vermont - August 17, 2009

A pregnant woman who lost her unborn twins in a crash in Bennington last week, is sparking a new call for change in Montpelier.

The other driver is charged with DUI, but cannot be charged with the deaths of the twins, because Vermont law does not define the unborn as "persons."

Vermont Right-to-Life pushed proposals to change the law in 2005, 2006 and 2007 to define unborn fetuses as "persons" if killed in the womb by violent crime, but those proposals went nowhere.

"There seems to be a fear at the Statehouse to address anything that comes close to calling an unborn child a human being, even though, for the purpose of the law, abortion is exempt. We are simply talking about another actor taking the life of a woman's child in-utero. But that just seems to put up a roadblock," said Mary Hahn-Beerworth of Vermont Right-To-Life.

Similar laws are already enacted in 36 other states and under federal law.
