Lawyer seeks lesser sentence for NH tax evader

Associated Press - October 1, 2009 10:55 AM ET

CONCORD, N.H. (AP) - A defense lawyer wants a lighter sentence than federal rules dictate for Elaine Brown, who was convicted with her husband of plotting to kill federal agents during a nine-month standoff at their Plainfield, N.H., home following their tax evasion case.

Elaine Brown's sentencing is Friday. 2 of her convictions are punishable by life terms, but her lawyer argues that 30 years plus one month is more fitting. In a recent motion, lawyer Bjorn Lange says that would amount to a life sentence for the 68-year-old woman, and that while there's no denying she's a convicted felon, "she is exceptional."

The Browns, who insist the federal income tax is unconstitutional, holed up in their hilltop home in Plainfield in early 2007 after being sentenced to five years in prison for tax evasion.
