NY man gets 7-21 years in fatal DWI crash

Associated Press - October 29, 2009 4:55 PM ET

MINEOLA, N.Y. (AP) - A Long Island man with one DWI conviction already on his record has been sentenced to 7 to 21 years in prison after admitting he was drunk when he killed a driver in a head-on crash.

Persi Esquivel of Valley Stream pleaded guilty in Nassau County Court in September to charges including aggravated vehicular homicide and aggravated DWI. He also violated the terms of his probation from a 2006 DWI conviction by removing a court-ordered ignition interlock device from his car.

Prosecutors say Esquivel crossed a double-yellow line divider in Farmingdale last November, slamming into a car driven by 21-year-old Jason Shein of Levittown.

Shein was home for Thanksgiving break from the University of Miami.

Prosecutors say Esquivel's blood-alcohol reading was triple the legal limit of 0.08.
