New Trial Date Set for Man Accused of Killing Jogger

Steven Baker Steven Baker

Elizabethtown, New York - June 4, 2008

A trial date has been set for a New York man whose conviction for a deadly drunk driving crash was overturned.

26-year-old Steven Baker, of West Chazy, was found guilty of killing 20-year-old Albert Montanaro as he was jogging along Route 373 in Chesterfield New York two years ago.

But an appeals court overturned his manslaughter and drunk driving convictions. The court said there was not enough proof that police had properly calibrated the blood alcohol detector when Baker was tested.

After Baker rejected a plea deal, a judge set a July 14th trial date.
