Kolibas faces new charges

Burlington, Vermont - February 23, 2010

A Williston man accused of drugging his daughter's friend at a sleepover faced new charges Tuesday morning.

Prosecutors say Robert Kolibas, 51, laced a 13-year-old girl's smoothie last May, and then sexually assaulted her.

Tuesday, Kolibas was arraigned on a felony charge of unlawful restraint. He pleaded innocent and his lawyers will try to get the charge thrown out, arguing restraint does not apply to cases of drugging. They also will not fight a doctor's finding that Kolibas is mentally fit to stand trial.

"We have no basis at this point to go forward and argue that Mr. Kolibas is not competent," said Leroy Yoder, Kolibas' lawyer.

A week-long jury trial is set for late March. Prosecutors would not comment on whether a plea deal to avoid trial is in the works.
