Lawyers for accused murderer Michael Jacques want his trial moved out of the federal court system.
If he's convicted in federal court for the 2008 rape and murder of his 12-year-old niece Brooke Bennett of Braintree, he could face the death penalty.
Jacques' lawyer will ask the case be moved to the state court, where there is no death penalty. Defense lawyers claim charges against Jacques involve crimes in Vermont, not across state lines, which are required for trial in the federal system.
