U.S. Supreme Court won't hear Fell appeal

Washington, D.C. - March 23, 2010

A Rutland man on death row for kidnapping and murder has lost another chance to appeal.

Twenty-nine-year-old Donald Fell was sentenced to death in 2005 for the 2000 abduction and slaying of 53-year-old Terry King of North Clarendon. In 2008, a federal appeals court upheld the sentence, and last year a panel also upheld the sentence.

Fell's lawyers recently petitioned the U.S. Supreme Court to hear his appeal, but on Monday they decided not to hear it.

Fell is currently on death row in Indiana.
