A Bennington nursing home patient won't face criminal charges despite allegations that he killed a dementia patient.
Police say 58-year-old Rodolfo Davalos attacked 84-year-old Dorothy Papero last week after she mistakenly wandered into his room at Crescent Manor Nursing home. Davalos thought Papero was an intruder.
It's not Davalos' first run-in with the law. He was facing criminal charges in 2003 for an alleged drunk driving incident but the charges were dropped after he was found not competent to stand trial.
