A judge has denied another motion from the lawyers of accused killer Michael Jacques challenging the death penalty.
Jacques is accused of kidnapping, raping, and killing his 12-year-old niece Brooke Bennett in 2008.
According to the Burlington Free Press, the 45-year-old's lawyers argue that since Vermont has no death penalty and kidnapping is usually a state level crime, an execution cannot be ordered because the case is tried in federal court.
Judge William Sessions disagreed and denied the motion.
