A Chittenden County judge is siding with a teen charged with seriously injuring a pedestrian because she was texting while driving.
Lawyers for Emma Vieira asked Judge Tim Tomasi to throw out statements she made to police about the accident. Police questioned her four days later, but the Judge sided with Vieira, saying investigators should have read her her rights -- because she was technically in custody.
The ruling does not impact statements she made to police earlier.
