MONTPELIER, Vt. -
The state of Vermont is asking a federal judge to dismiss a lawsuit filed by the owners of Vermont Yankee.
The Vernon nuclear plant is suing the state over a new tax bill. The Legislature passed a law this year that raises the generation tax on the plant from $5 million to nearly $13 million. Yankee's owners say the law singles them out and is unconstitutional.
The state says this is not a matter for the federal courts, but should be heard in state court.
