Judge asks prosecutors for update in taser case

A battle in court over a grieving girlfriend's plans to sue the state.

Macadam Mason died in June during a confrontation with state police outside a Thetford home. An autopsy shows Mason died of a heart attack caused by the shock of a Taser stun gun.   The investigation into the incident has been ongoing for seven months.  Mason's girlfriend, Theresa Davidonis, is suing the state police over the incident and wants records of the investigation turned over.

"The objection to producing the documents first was that there was a criminal process underway and Theresa's position was, is there or is there not. And if so, how long does it take to reach a decision?" said Tom Costello, Davidonis' lawyer.

The judge told Assistant Vermont Attorney General Jana Brown  to update him on the status of their investigation within two weeks.  It's not clear when the judge will make a ruling regarding the state's request to dismiss.
