A Vermont man has faced two murder convictions and twice they have been overturned.
Prosecutors say they plan to re-try Dennis Tribble, 62, on a first-degree murder charge. Tribble has not said if he will represent himself or seek a lawyer.
He shot and killed his neighbor Mike Borello in North Wolcott 13 years ago. Tribble claims it was self-defense. Juries disagreed.
The state's high court says his latest conviction in 2009 should be thrown out, because his lawyer presented evidence Tribble did not want introduced that he was mentally ill.
Tribble's first conviction was tossed because he boycotted his trial and the court said his defense was not adequate.
