Prosecutors will try for a third time to convict Dennis Tribble for a murder that happened nearly 13 years ago.
Tribble has already been found guilty twice for shooting his North Wolcott neighbor Michael Borello. But after both trials, the Vermont Supreme Court overturned the conviction.
The first time Tribble acted as his own lawyer, but then boycotted the trial, so the high court said his defense was inadequate.
The second time he had a lawyer who told the jury about Tribble's mental health issues. The Supreme Court said Tribble's wishes to exclude that information should have been granted.
Tribble was formally arraigned Tuesday on a second-degree murder charge. The arraignment was necessary because Tribble was previously charged with
first-degree murder. But because he was convicted of second-degree murder, he
cannot be retried for first-degree murder.
Tribble did not enter a plea and the judge ordered he
undergo a mental competency evaluation.
