Year in federal prison for upstate NY pot smuggler

UTICA, N.Y. (AP) - A 23-year-old northern New York man has been sentenced to a year in federal prison for trying to smuggle marijuana across the border with Canada.

Prosecutors say Eric Wilson of Saint Regis Falls pleaded guilty in January after a federal appeals court ruled the Jan. 10, 2010 seizure of 125 pounds of marijuana by Mohawk tribal police was constitutional.

The car was stopped after officers saw it driven into Canada and return at an unguarded and unmarked border crossing on the Saint Regis Mohawk Reservation.

A trial-level judge had ruled the St. Regis Mohawk and Akwesasne Mohawk officers violated Wilson's rights when they searched his car beyond reservation boundaries. But the appeals court said one of the officers was cross-designated as a U.S. customs officer, making the search legal.

Wilson was sentenced last week in Utica.
