The debate continues over who can be banned from the Church Street Marketplace in Burlington.
The city's current no-trespass ordinance allows for people to be banned from the space for repeat offenses involving drugs, alcohol and disorderly conduct.
But some city councilors are questioning its constitutionality and are calling for the city attorney's memo on the ordinance to be made public.
"We think it gets to the essence of open government that the no-trespass ordinance represent the city is using its power as the state to remove people from public," said Jane Knodell, P-Burlington City Council.
Knodell is urging her colleagues to revisit the ordinance. She says at least one individual has already received a no-trespassing order since it went into place May 1.
