Memo on Burlington no-trespass ordinance made public

A memo from the Burlington city attorney to the City Council is now public.

The memo, written a year ago, explains the then-city attorney's decision that a no-trespass ordinance on Church Street is constitutional.

The memo had been sealed under attorney-client privilege, but after a former city attorney called into question the constitutionally of the no-trespass order, many called for the memo to be made public.

The memo-- now public-- explained it was likely to defeat any legal battle because it's modeled after other similar trespass ordinances.

The memo will now go back to the ordinance committee and because it is now public. the committee will likely hear testimony from those both supporting and calling into question that finding.

The committee is set to report back to the council by October.
