FORT EDWARD, N.Y. (AP) - A northern New York man accused of killing his 3-month-old son faces a second-degree murder charge.
Local media report that a grand jury indictment handed up Thursday alleges that 30-year-old Kevin Wayne King acted with depraved indifference when he slammed his infant son Brett to the floor of the family's Fort Edward apartment on Aug. 11.
Police say King was playing a videogame and became frustrated when the child wouldn't stop crying and fussing.
King also was charged with first-degree manslaughter and a misdemeanor charge of endangering the welfare of a child. He pleaded innocent during an arraignment and was sent to the Washington County Jail without bail.
Public Defender Michael Mercure said he believes the evidence does not support the murder count in the case.
Fort Edward is 45 miles north of Albany.
