1 accused soda bomber asks court to dismiss charge

NEWPORT CITY, Vt. -

One of the three teens accused of setting off soda bombs outside a classmate's home is asking the court to dismiss a charge.

Police say back in May, the teens built soda bottle bombs and planted them outside the classmate's house on Concord Avenue in Newport.

No one was hurt, but a window was blown out.

Joshua Tompkins, 19, along with Jason Hatin, 18, and Colin Brennan, 16, face counts of unlawful mischief and possessing and manufacturing a destructive device.

Tompkins' attorney told the court Monday he wants the second charge dropped. He says it is too vague and the soda bombs don't meet the standards of the charge.

The Caledonian Record reports the state's attorney says the facts prove it was more than just a prank, saying the trio had "sinister" intent.
