BURLINGTON, Vt. -

The Burlington man accused of beating his wife with a baseball bat will not seek to get out on bail.

James Scarola, 40, has been jailed without bail since being charged with attempted murder. Police say he bashed his wife, Colleen, in the head with an aluminum bat last weekend. A bail hearing was scheduled for next Monday, but prosecutors say Scarola's lawyer has agreed to have his client remain behind bars.

Colleen Scarola remains in critical condition at Fletcher Allen Health Care.
