Judge denies new trial for nursing home worker

BRATTLEBORO, Vt. -

A judge has denied a new trial to the nursing home employee found guilty of stealing money from a resident who died.

A jury acquitted Jodi LaClaire of second-degree murder charges in the death of 83-year-old Nita Lowery, but did find her guilty of financial exploitation for stealing more than $3,000 through the use of Lowery's ATM card. LaClaire appealed the conviction, but the judge ruled the evidence was sufficient and denied the defense's motion to acquit or re-try.
