Judge: Pazos incompetent to stand trial for 2010 murder

BURLINGTON, Vt. -

A judge has ruled that a homeless man accused of killing a Burlington woman four years ago is incompetent to stand trial.

Jose Pazos allegedly stabbed and killed 50 year old Kathleen Smith inside her Park Street home in November 2010. Police say he did it because he was angry that the Burlington social worker sided with a friend in her child custody battle against Pazos.

A state psychiatrist first ruled in 2012 that though Pazos suffered from persecutory delusions, he was mentally competent to face the charges against him in court. But after delays in the case, the judge ordered a new evaluation and now the state psychiatrist believes Pazos lacks a rational understanding of the case and could not assist his attorney in mounting a defense.

The ruling likely means Pazos will be placed in a state mental facility indefinitely.
