Man charged with killing 2 outside Hubbardton home

The family of Shane and Chris Plummer couldn't hold back the tears as Sylvester Labartino, 70, was brought into court Thursday. Labartino is charged with two counts of second-degree murder. Police say he shot and killed Shane Plummer, 57, and his son, Chris Plummer, 26, outside of Labartino's rented Hubbardton home Wednesday afternoon.

"It just doesn't seem real - it just doesn't seem real," said Michelle Charron, Shane's sister.

Court documents say the Plummers had been hired by Labartino's landlord to do work at the property, and the landlord had told police he had been having trouble with his tenant over that issue. Earlier in the day, family members say the father and son had been to the property, but Labartino prevented them from doing maintenance work. The fatal encounter happened when police say Labartino returned from an appointment and found the electricians back at the house.

"He was a good hard worker and a good dad and a good brother," Charron said.

According to court papers, Shane Plummer may have seen his son shot. A call was placed to 911 from Shane Plummer's cellphone number saying, "I need help, my son has just been shot and he chased me out of my truck with a rifle."

"He was a good guy," Charron said. "He wouldn't hurt a fly-- maybe a fly, but would do anything mean or cruel to anybody."

Court documents show that Labartino has a laundry list of a rap sheet, including driving under the influence of drugs, disorderly conduct, DUI and extortion. His defense asked that his criminal record not be presented in court, as they did not fight the bail amount offered by the state.

Labartino's bail was set at $750,000 and he is being held at Marble Valley Correctional facility. If convicted, he faces a minimum of 20 years in prison.
