Prosecutor: Animal abuse case not over

BURLINGTON, Vt. -

All charges in an animal abuse case have been thrown out of court because of a technicality, and now the state's attorney is reacting.

George Wilson faced six counts of animal cruelty stemming from horses found on his Shelburne farm that officers say were in deplorable conditions.

But the court ruled the search of Wilson's property last January by the town's health officer without a warrant was illegal. As a result, all the evidence of alleged abuse found couldn't be used in court. And without that evidence, all charges were dropped.

Chittenden County State's Attorney T.J. Donovan says his office has been getting calls from the public upset about the ruling, and he says the case isn't over.

"Because the allegations were so horrific, we want to do our due diligence and make the right decision. Look, this is how this process plays out-- you receive adverse judgments, but you also have recourse that you can seek whether through an appeal process or asking the judge to reconsider and that's what we're doing right now," Donovan said.

Donovan says his office is deciding by the end of the week whether to ask for that reconsideration or to appeal to the Vermont Supreme Court.

Wilson is representing himself. He told us he has no comment about the judge's ruling.

Wilson is a former long-time employee of Channel 3 News.
