NH bill allows mental health gun record annulment

CONCORD, N.H. (AP) - The New Hampshire Senate has voted to create a process to annul mental health records that block the person from buying guns.

The Senate voted 17-7 Thursday to send the House a bill that allows people to petition to have their names and mental health information removed from the federal National Instant Criminal Background Check System. Federal law bars people who have been involuntarily committed to a mental health facility or declared mentally ill by a judge from legally buying guns from licensed dealers.

The bill sets up a process to petition the court to remove the information if they are no longer under guardianship, involuntary treatment or involuntary commitment.

The Senate voted to eliminate a proposed committee to study mental health and firearms issues.
