Leicester man charged with shootings appears in court

A man charged with shooting his neighbor and two Vermont State Police officers was in court Thursday in Middlebury.

Timothy Foley wasn't there last time, but this time he showed his face to friends and family of the man police say he shot, as well as Vermont State troopers there to support the two officers who he is also accused of shooting.

"He did something wrong and he needs to pay. He needs to pay for it," said Bill Mason, the son-in-law of victim Mahlon McCoy.

The family of Mahlon McCoy is still angry following the shooting of their family member. Foley denied two counts of attempted aggravated murder and two counts of attempted murder in court. He's accused of breaking into McCoy's house and shooting him and attempting to shoot his wife, and then later shooting two Vermont State Police officers, Sgt. Eugene Duplissis and Tpr. Matt Daley, when they arrived outside his home in Leicester April 9.

Foley's attorney asked the court to allow 60 days for medical records to be presented after a mental health examination Foley received Friday. Judge Robert A. Mello allowed the time for the material to be presented. 

Investigators have not indicated a clear motive for the shooting, but police had been called to Foley's house earlier that morning because he was hearing voices.

McCoy's family says he is recovering, but has several surgeries scheduled. They tell us McCoy and his wife, who was there when Foley allegedly shot her husband, have vacated their Leicester home and do not plan to return. 

"We gotta take it one step at a time. At least they are holding him still, he's not getting out," said Sadie Mason, McCoy's daughter.

McCoy's family tells us he already suffered from hearing loss. With the injury he can no longer use his hearing aid in that ear and has extreme difficulty hearing. Foley is set to appear in court again June 23.
