Controversial Burlington trespassing ordinance has its day in court

BURLINGTON, Vt. - A lawsuit calling a Burlington city ordinance's constitutionality into question began Friday.

The ordinance says a person can be issued a trespassing notice on the Church Street Marketplace for disorderly conduct or illegal activity.

Plantiffs argue this is unconstitutional, violating free speech and due process rights.

The city says the ordinance is only issued after a person has committed a violation of the law and, therefore, is justified. Testimony is set to wrap up by the end of the day.
