No charges in fatal shooting of Vt. Guard vet

BURLINGTON, Vt. -

A night out celebrating turned deadly.

"This is incredibly traumatic. It's incredibly tragic at a lot of different levels," Chittenden County State's Attorney T.J. Donovan said.

Police say on the night of April 25, Kryn Miner, 44, of Essex Junction, was at a wedding with his family. They say he'd been drinking. When the family returned home, police say Miner began physically and verbally abusing his wife, and then moved on to his children.

"Mr. Miner threatened to shoot his children. He stated quote, 'I'm going to kill all of you,'" Donovan said.

Donovan says one of Miner's four children, a teenager, then stepped in to defend the family after their father tossed a gun and said, "Do you want to play the gun game?"

"Mr. Miner reached into the bag he was holding and began pulling out another gun later described as a 9-millimeter. The Miner teenager, seeing the other gun, fired the gun that was previously given to him," Donovan said.

Investigators say the teen then fired six shots.

"The Miner teenager continued to shoot Mr. Miner because the teenager quote, 'Thought he was going to get up,'" Donovan said.

Kryn Miner served multiple tours in Afghanistan and suffered from post-traumatic stress disorder and a traumatic brain injury. He had no prior record of domestic violence.

"In the past, when Mr. Miner would become upset, Mrs. Miner on occasion would be able to de-escalate the situation by talking with him," Donovan said. "In spite of her efforts this time, Mr. Miner became increasingly agitated."

The state will not be bringing any charges against the teen, saying the actions were legally justified. Under Vermont law, people have the right to defend themselves when when they believe they are in imminent danger.

"This conclusion is based on the fact that Mr. Miner had a gun, pointed his gun at the wife and Miner teenager, stated he was going to kill his family and was acting with an extreme indifference to the value of human life," Donovan explained.

In a statement from the Miner family read by their personal attorney, Jason Sawyer, they say they remember Kryn as a loving husband and father. But they say his injuries from years of defending our country were too strong to overcome.

"For all of our veterans who may be active or retired, let's not abandon them. For people like Kryn and other vets with traumatic injuries, the quality of a better life is the responsibility of all of us," Sawyer read from the statement.

Donovan also said the state has filed a motion to redact any information within the affidavit or search warrant that would reveal the identity of the child. The court has yet to make a ruling on that request.
