POULTNEY, Vt. - The death of 2-year-old Dezirae Sheldon launched a massive review of DCF earlier this year. Now, Dezirae's mother is moving for parental rights to a baby she has with the man charged with killing Dezirae.

Sandra Eastman filed for divorce in March from Sheldon's stepfather, Dennis Duby. He faces a murder charge in Dezirae's death and is free on bail. In July 2013, Eastman pleaded guilty to child cruelty for failing to get Dezirae prompt medical care for a broken leg.*

Now, Eastman and Duby are arguing over family assets and another issue-- their 5-month-old baby who is in DCF custody. Eastman has filed for parental rights and parental contact. And a relative of Duby's is trying to get custody of the baby.

DCF would not confirm its involvement citing confidentiality rules.

*Editor's note: Authorities brought to our attention on June 26, 2014, that WCAX News previously reported Sandra Eastman was convicted of breaking Dezirae Sheldon's leg. That was incorrect. Eastman was convicted of child cruelty by medical neglect. We apologize for the error.
