Opponents vow to fight the ruling calling tenure unconstitutional, says Los Angeles employment attorney Eric Grover.

California teachers are reeling after a decision by a Los Angeles judge finding that many of their tenure-based employment safeguards are unconstitutional, leaving teachers will little job protections compared to what they once enjoyed, says Los Angeles employment attorney Eric Grover of Keller Grover LLP.

Los Angeles County Superior Court Judge Rolf Treu decided that the rules surrounding teacher tenure and when they can be fired were unconstitutional.

The decision was made after Students Matter, an organization acting on behalf of public school students, filed the lawsuit challenging teacher tenure on grounds that students have a right to quality public education, which is hindered by ineffective teachers who are protected by tenure rules.

“All sides to this litigation agree that competent teachers are a critical, if not the most important, component of success of a child’s in-school educational experience,” Treu wrote.

Treu also stated that permanent employment rules is result in a “lose-lose situation” that creates a “torturous” process for dismissing teachers from their roles as it’s “so complex, so time consuming and expensive as to make an effective, efficient yet fair dismissal of a grossly ineffective teacher illusory.”

The California Teachers Association stated that the ruling is “deeply flawed” and plans to appeal, the Sacramento Bee reported.

“Circumventing the legislative process to strip teachers of their professional rights hurts our students and our schools,” the union said. “This lawsuit has nothing to do with what’s best for kids, but was manufactured by a Silicon Valley millionaire and a corporate PR firm to undermine the teaching profession and push their agenda on our schools.”

“If this ruling isn’t overturned in the appeals process, it’s important that there are clear standards that teachers must abide by in order to maintain their employment standings. Otherwise this just opens the door for unjustified terminations and abuse of the system,” says Los Angeles Employment lawyer Eric Grover.
