Former UVM student convicted of sexual assault to get new sentence

BURLINGTON, Vt. - A former University of Vermont student convicted of sexually assaulting a classmate will get a new sentence.

The Vermont Supreme Court ruled Friday that the trial judge erred when he effectively gave Yetta Lumumba a life sentence.

Lumumba was found guilty two years ago for forcing a woman to perform oral sex. Judge Brian Grearson sentenced him to eight years to life in prison.

Because Lumumba is not a United States citizen he faces deportation when he gets out, but because he faces deportation, he is not eligible for the sex offender treatment he is required to undergo in order to get out of prison.

The Supreme sent the case back to Judge Grearson to consider those consequences when fashioning a new sentence for Lumumba.
