2nd trial begins for Vt. prison guard

BURLINGTON, Vt. - A prison guard accused of sexually assaulting a female inmate was back in court Tuesday.

A July mistrial prompted prosecutors to try the case again.

The inmate claimed Richard Gallow touched himself inappropriately in front of her cell and assaulted her. The alleged assault happened in October 2010 at the Chittenden Regional Correctional Center.

Gallow's attorney and the state presented their arguments before a jury Tuesday morning.

"At the close of the evidence, I will have a chance to come up and talk with you again and tell you what the state believes the evidence showed and at that time I'm going to be asking that you return a verdict of guilty," Prosecutor Susan Hardin said.

"We have to piece together a day-- now it's almost four years later. I think when you hear all the evidence, there can only be one decision. There's too much doubt in the testimony," Defense Lawyer Harley Brown said.

The case is expected to take several days as the court hears from witnesses and the victim.
