BURLINGTON, Vt. (AP) A federal jury has been selected to determine whether a Rutland police officer used excessive force during a traffic stop.
Kevin Elnicki, owner of Earth, Waste and Metal, contends patrol officer Ryan Ashe drew his gun during the stop in December 2016. Elnicki contends he was forcibly removed from the cab of his flatbed truck and slammed to the ground.
The Rutland Herald reports that the trial is set for Aug. 19.
Ashe said in a court affidavit that Elnicki drove for several miles after the officer put on his siren. He said he never pointed his gun at Elnicki and that there was no excessive force.
The driver was cited for speeding and failing to obey an officer. The newspaper reports that the citations were dismissed in 2017.
