Judge: Prosecutors can hold cellphone as evidence in murder case

BARRE, Vt. (WCAX) A Washington County judge has ruled that prosecutors can hold onto a cellphone in connection with a Montpelier murder investigation.

Jayveon Caballero is accused of killing Markus Austin in January. It happened after a night out at a bar that allegedly went bad and ended up with Caballero allegedly shooting Austin outside his Montpelier apartment.

During the investigation, police seized the phone of Eduard Begagayev of Barre, saying it was used in significant communication between Begagayev and witnesses in the case. The Times Argus reports that federal officials are trying to decrypt the device and that the judge has allowed them to keep the phone until a trial date next June.
