When is DCF responsible for the behavior of children in its care?

BURLINGTON, Vt. (WCAX) When is the Vermont Department for Children and Families responsible for the behavior of the children in its care?

A case earlier this month attempts to answer that question. A child in DCF custody bit another child at a Rutland McDonald's. The victim's family sued, saying DCF should have warned its employees and the public that the boy was a threat to the public. The state won that case. But why?

Legal expert Dan Richardson was not directly involved in this case. Richardson he spoke with our Roger Garrity to help us understand this ruling. Watch the video for the full interview.
