A GPS WAS ALLEGEDLY STOLEN FROM

HER CAR.

AND BOTH THOSE CASES, NO

PHYSICAL EVIDENCE WAS RECOVERED,

AND THERE WAS INSUFFICIENT

EVIDENCE TO IDENTIFY A SUSPECT

AND THEREFORE BRING A CRIMINAL

CHARGE.

AND SO IN TERMS OF THE PROPERTY

CRIMES, THERE JUST WASN'T ANY

EVIDENCE TO PROSECUTE SOMEBODY.

WE DIDN'T HAVE A SUSPECT.

IN REGARDS TO THE SPEECH, YOU

NOW ARE TALKING ABOUT THE FIRST

AMENDMENT AND IT'S IMPORTANT TO

NOTE THE FIRST AMENDMENT, WHICH

OF COURSE IS FREEDOM OF SPEECH,

IS A VERY HIGH THRESHOLD AND

MOST SPEECH IS PROTECTED SPEECH.

EVEN THINGS THAT ARE HATEFUL,

THAT ARE UNPLEASANT, THAT ARE

CAUSTIC, THAT IS WHAT -- THAT IS

FIRST AMENDMENT IN THIS COUNTRY.

A COUPLE OF EXAMPLES.

CASES WHICH WE CITED IN OUR

FINDINGS.

PRESIDENTIAL CANDIDATE PRESIDENT

OBAMA, SOMEBODY POSTED ONLINE

BASICALLY SAYING I'M GOING TO

PUT A 50-CAL IN HIS HEAD.

THE COURT HAS SAID THAT IS

PROTECTED SPEECH.

ANOTHER CANDIDATE, ELECTED

OFFICIAL, GOVERNOR OF

WASHINGTON, SOMEBODY MADE A

THREAT OF SEXUAL VIOLENCE

AGAINST A CHILD OF THE GOVERNOR

AND SAID THAT SHE SHOULD BE

BURNED AT THE STAKE.

THE COURT SAID THAT WAS

PROTECTED.

SO IT'S A VERY HIGH THRESHOLD

WHEN YOU'RE TALKING ABOUT

PROTECTED SPEECH.

THE ONE EXCEPTION IS WHAT WE

CALL A TRUE THREAT, WHICH IS A

LEGAL TERM, AND IN THIS CASE,

THE HARASSMENT, THE RACIAL

HARASSMENT, WHICH I CONDEMN,

WHICH IS RACIST, WHICH IS

DEMEANING, DEROGATORY, IN THIS

CASE, IT DID NOT RISE TO THE

LEVEL OF THAT TRUE THREAT, WHICH

IS A LEGAL TERM, AND THEREFORE

IT WAS PROTECTED SPEECH.

AND I HAVE TO SAY THIS, DARREN,

THAT IN OUR DEMOCRACY, WE DON'T

THROW OUT THE LAW, WE DON'T

THROW OUT OUR CONSTITUTION

BECAUSE WE'RE IN DIFFICULT TIMES

AND I DON'T THINK THE POLITICAL

CLIMATE SHOULD DICTATE WHO GETS

PROSECUTED AND WHO DOESN'T GET

PROSECUTED.

I THINK THE FIRST AMENDMENT IS

CLEAR.

IT STOOD THE TEST OF TIME.

YES, THESE ARE CHALLENGING

TIMES, THEY'RE EMOTIONAL TIMES.

I CONDEMN THE RACISM, I CONDEMN

THE HATE, BUT WE NEED TO RISE

ABOVE IT AND COME TOGETHER AS A

COMMUNITY AND NOT FORGET WHAT

MADE THIS COUNTRY GREAT IN THE

FIRST PLACE, AND THAT'S OUR

CONSTITUTION.

WERE RIGHT, THAT THERE WASN'T

ENOUGH TO BRING CHARGES.

OR DID THE P.D. NOT DO ENOUGH?

IN TERMS OF THE CALLS OF DOING

ITS INVESTIGATION.

AS I SAID, THEIR WORK PRODUCT IN

PROPERTY CRIMES WAS CONSISTENT

WITH MOST LAW ENFORCEMENT

AGENCIES IN THIS CASE.

I THINK WHEN YOU TALK ABOUT THE

ISSUE OF RACISM, WHEN YOU TALK

ABOUT THE ISSUE OF BIGOTRY,

SOMETHING IS -- SOMETHING

GREATER IS REQUIRED THAN JUST

OUR NORMAL POLICE WORK, THOUGH.

WE HAVE TO UNDERSTAND AND LISTEN

TO PEOPLE OF COLOR'S EXPERIENCE,

WE HAVE TO VALIDATE THEIR

EXPERIENCE.

WE HAVE TO BELIEVE THEM AND

THERE'S GOT TO BE THAT EMOTIONAL

RESPONSE FROM LAW ENFORCEMENT

THAT PEOPLE FEEL PROTECTED,

PEOPLE WHO HISTORICALLY HAVE

BEEN VICTIMS OF RACISM, HAVE

BEEN PERSECUTED, THIS IS THE

CHALLENGE WE'RE FACING.

AND SO WE HAVE TO COME UP WITH

NEW WAYS OF ADDRESSING THIS

ISSUE, OF MAKING SURE EVERYBODY

FEELS SAFE, OF MAKING SURE THAT

EVERYBODY HAS EQUAL PROTECTION

UNDER THE LAW.

THAT'S WHY WE ANNOUNCED OUR NEW

BIAS INCIDENT REPORTING SYSTEM,

BECAUSE AS I SAID, MOST OF THESE

CRIMES DON'T EVEN GO TO THE

POLICE.

THAT'S GOING TO BE THE FIRST

CALL THE VERMONTER MAKES,

RIGHTFULLY SO, BUT A LOT OF

TIMES, AND WE'VE SEEN THIS TIME

AND TIME AGAIN THROUGH MANY

POLICE AGENCIES, THEY SAY THIS

IS PROTECTED SPEECH AND IT ENDS

THERE.

WHAT WE'RE GOING TO DO IS BRING

IN ALL THE PROSECUTORS, THE

STATES ATTORNEYS THROUGHOUT THE

STATE, WE'RE GOING TO BRING IN

THE CIVIL RIGHTS UNIT, WE'RE

GOING TO MAKE SURE OUR FEDERAL

PARTNERS, THE PROSECUTORS AT THE

U.S. ATTORNEYS ARE INVOLVED AND

WHEN THOSE BIAS INCIDENTS OCCUR,

WE'RE GOING TO MAKE SURE

EVERYBODY IS TAKING A LOOK AT

IT, BECAUSE IT MAY NOT BE A

CRIMINAL PROS KU, BUT IT MAY BE

A CIVIL RIGHTS VIOLATION.

SO WE'RE GOING TO EXPAND THE

FIELD, PUT MORE PLAYERS ON THE

FIELD, SO WE'LL HELP MORE PEOPLE

IN THE STATE TO ADDRESS THE

ISSUES OF HATE, ADDRESS THE

ISSUES OF BIAS, AND PROTECT

PEOPLE.

BUT NOW VERMONT GETS TO SEE, AND

I THINK THAT'S TRUE.

THIS IS REALITY.

WE HAVE WHITE SUPREMACISTS IN

THIS STATE.

THEY COME TO PROVOKE, TO A

SYNAGOGUE WEARING A SYMBOL OF

ANTI-SEMITISM.

THEY COME TO PROVOKE AND UPSET

PEOPLE DELIBERATELY, AND OUR

CHALLENGE, AGAIN, IS NOT TO

FORGET OUR RULE OF LAW.

OUR CHALLENGE IS TO RISE ABOVE

IT AS A COMMUNITY, TO ADDRESS

ISSUES OF HATE SPEECH WITH MORE

SPEECH, NOT ABOUT HATE, BUT

ABOUT LOVE, ABOUT COMPASSION,

ABOUT SOLIDARITY, BY MAKING SURE

WE'RE PASSING LAWS AND

INITIATIVES FROM OUR SELECT

BOARDS ALL THE WAY TO OUR STATE

LEGISLATURES TO GIVE PEOPLE

OPPORTUNITY AND HOPE IN THIS

STATE AND MAKING SURE, FINALLY,

BY DEMONSTRATING THAT WE DO, WE

DO FOLLOW OUR RULE OF LAW, EVEN

WHEN IT'S UNPOPULAR, THAT IS THE

TEST OF THIS DEMOCRACY.

THAT IS THE TEST OF THIS TIME

THAT WE'RE IN, WHICH IS AN

INCREDIBLY DIFFICULT, EMOTIONAL

TIME, BUT I DON'T THINK WE CAN

FORGET OUR LAWS BECAUSE THE

SPEECH, DARREN, THAT ALLOWS YOU

TO GET UP AND SAY SOMETHING OR

ALLOWS ANYBODY TO GO ON THE

STREET CORNER AND SAY, I MAY

AGREE WITH AND I'M GOING TO

DEFEND IT, BUT I ALSO HAVE TO

DEFEND SOMEBODY WHOSE SPEECH I

DISAGREE WITH AND MAY BE

UNPOPULAR AS LONG AS THEY DON'T

CROSS THE LINE AND VIOLATE THE

FIRST AMENDMENT.

THAT'S THE CHALLENGE WE'RE

FACING RIGHT NOW.

WE NEED TO COME TOGETHER AS A

STATE AND ADDRESS THIS.

BEING DEFENSIVE AND WE HAVE TO

LISTEN, WITH EVER -- WE HAVE TO

LEARN AND WE HAVE TO HAVE SOME

TOUGH CONVERSATIONS AND THAT'S A

BIG STEP IN THE RIGHT DIRECTION.

THAT'S WHY WE'RE DOING THESE

COMMUNITY FORUMS.

IN TERMS OF LEGISLATION, I FULLY

SUPPORT IT, BUT WE GOT TO FIND A

WAY THAT BALANCES PEOPLE'S

CONSTITUTIONAL RIGHTS WHILE

PROTECTING PEOPLE.

I THINK WE CAN DO SOMETHING.

I LOOK FORWARD TO WORKING WITH

THE LEGISLATURE TO ADDRESS THIS

ISSUE, AND THIS IS A TRUE TEST

FOR US.

THIS IS, AS I SAID IN MY SPEECH,

THE GREAT TASK BEFORE US IS TO

ADDRESS THE ISSUE OF RACISM IN

OUR STATE, AND I THINK AS I SAID

IT'S HAPPENING, AND PEOPLE OF

COLOR HAVE BEEN VICTIMS OF IT

CHOICE.

ADDRESS, THIS OR WE CAN CONTINUE

TO KEEP OUR HEAD IN THE SAND IF

PEOPLE DESERVE BETTER.

THAT DEMONSTRATES OUR FIDELITY
