>> Announcer: FROM WCAX, THIS IS
"YOU CAN QUOTE ME."
>> Darren: GOOD MORNING,
EVERYONE.
I'M DARREN PERRON.
RIGHT NOW ON "YOU CAN QUOTE ME,"
TRACKS AND TRESPASSING.
WHAT YOU NEED TO KNOW ABOUT
STAYING SAFE ON RAILROAD TRACKS.
PLUS, THE DOS AND DON'TS.
YOU MIGHT BE BREAKING THE LAW.
NEWS THAT IMPACTS ANYONE IN
VERMONT WHO HAS A CAR.
THERE ARE CHANGES TO HOW YOUR
CAR'S FAULTY EMISSIONS GET
FIXED.
WHAT YOU DO BEFORE YOU GET YOUR
NEXT INSPECTION.
PLUS, ALLEGATIONS OF RACIAL
HARASSMENT.
A FORMER STATE REP DESCRIBES
WHAT SHE WENT THROUGH AND THE
MAN ACCUSED OF IT DISRUPTS THE
NEWS CONFERENCE.
WE'LL TALK TO THE ATTORNEY
GENERAL ABOUT IT AND WHY HE
CAN'T CHARGE THE MAN.
>> YOU CAN CRY ALL YOU WANT.
>> I'M NOT CRYING, I'M PISSED.
>> Darren: THAT THE MAN WHO SAYS
HE RACIALLY HARASSED KIAH
MORRIS, A FORMER VERMONT
LAWMAKER.
BUT HE WON'T FACE CHARGES.
THE ATTORNEY GENERAL SAYS FORMER
REPRESENTATIVE MORRIS WAS THE
VICTIM OF VICIOUS RACISM, BUT
THE SPEECH IS PROTECTED UNDER
THE FIRST AMENDMENT.
THE A.G. MADE AN ANNOUNCEMENT AT
A PRESS CONS AND OUR ADAM
SULLIVAN WAS THERE WHEN AN
UNEXPECTED GUEST SHOWED UP TO
SHAKE THINGS UP.
>> NEEDS TO BE SAID THAT I AM
NOT THE CAUSE OF RACISM IN THERE
STATE.
>> Reporter: KIAH MORRIS WAS
ELECTED TO A SECOND TERM
REPRESENTING BENNINGTON IN THE
VERMONT HOUSE OF
REPRESENTATIVES, BUT SHE RESIGN
ABRUPTLY LAST YEAR AFTER
BECOMING THE TARGET OF RACIAL
HARASSMENT ONLINE.
HER HOME AND CAR WERE ALSO
BROKEN INTO.
>> OUR LOCAL, REGIONAL, STATE
ECONOMIC CHALLENGES CANNOT BE
LAID AT MY FEET.
IT IS NOT ON ME TO MAKE EVERYONE
WHOLE AGAIN.
NOR IS IT MY BURDEN TO HELP US
ALL HEAL FROM THIS MOMENT.
>> Reporter: VERMONT'S ATTORNEY
GENERAL, T.J. DONOVAN, SAYS
MORRIS WAS THE VICTIM OF RACIAL
HARASSMENT, BUT SAYS NO CHARGES
WILL BE FILED BECAUSE OF FREE
SPEECH PROTECTIONS.
>> THE REMEDY IS NOT FOR THE
GOVERNMENT TO SUPPRESS IT.
>> Reporter: WHEN WE ASKED
MORRIS HER REACTION TO DONOVAN'S
REPORT --
>> HE SAID THERE'S NOTHING THAT
CAN BE DONE.
>> Reporter: HER RESPONSE WAS
INTERRUPTED BY THE MAN WHO
ADMITS TO HARASSING HER.
IT CAME AS A SHOCK TO MANY IN
THE ROOM.
>> WHY IS THIS ALLOWED?
WHY THIS IS ALLOWED?
>> Reporter: MACK SMITH SHOWED
UP WEARING A T-SHIRT THAT SOME
SAY AS OFFENSIVE SYMBOL OF THE
ALT-RIGHT.
WE CAUGHT UP WITH HIM AFTER THE
EVENT WHEN MEMBERS OF THE CROWD
CONFRONTED HIM.
>> ANYONE WOULD ACT STRANGE OR
WEIRD AT MY PRESENCE --
>> STRANGE AND WEIRD AT YOUR
FREQUENCE BECAUSE THIS SHIRT AS
SYMBOL OF HATE.
WHY DON'T YOU WEAR A NAZI FLAG
OR SWASTIKA SYMBOL.
>> THIS IS A FROG.
>> THAT IS A SYMBOL OF RACISM,
MISOGYNY AND ANTI-SEMITISM AND
YOU KNOW THAT.
YOU KNOW THAT WHEN YOU PUT IT
ON.
YOU KNOW PEOPLE ARE GOING TO
FEEL AFRAID AND SICKENED BY
THAT.
>> WHY DO YOU HAVE TO WALK INTO
A VALUABLE COMMUNITY
CONVERSATION WITH THAT SYMBOL OF
HATE.
>> BECAUSE I CAN.
>> Reporter: ARE YOU INTENTION
MALE BEING PROVOCATIVE?
>> YES, YES.
>> Reporter: WHY.
>> I JOAN I IT.
>> HE DOES IT FOR FUN.
>> Reporter: JOANNA CALDWELL
SAYS SHE SHOWED UP TUESDAY TO
SUPPORT RACIAL JUSTICE.
>> THE FACT THAT HATE CRIMES IN
VERMONT HAVE TRIPLED SINCE 2016
SHOULD SHOW US THAT WHAT WE
REALLY NEED IS FOR PEOPLE WHO
ARE ON THE SIDE OF THE LAW TO
GET REALLY CREATIVE.
>> Reporter: THAT CREATIVITY WAS
ON DISPLAY AS THE MAN WAS
SURROUNDED BY AUDIENCE MEMBERS
AFTER THE EVENT ABRUPTLY ENDED.
[ CHANTING ]
\M THIS LITTLE LIGHT OF MINE \M
\M I'M GONNA LET IT SHINE \M
>> Darren: AND TO TALK MORE
ABOUT THIS CASE, I'M JOINED NOW
BY THE ATTORNEY GENERAL IN
MONTPELIER, T.J. DONOVAN.
GOOD MORNING.
>> Donovan: GOOD MORNING,
DARREN.
THANKS FOR HAVING ME.
>> Darren: YOU'RE WELCOME.
THANKS FOR BEING HERE.
KIAH MORRIS REPORTED VANDALISM
TO HER PROPERTY, SAYS SHE WAS
HARASSED AND THREATENED, SO WHY
ISN'T THIS ENOUGH TO BRING
CHARGES?
NOT ENOUGH PROOF?
IT SEEMS TO ME LIKE MORE THAN
JUST FREE SPEECH.
>> Donovan: WELL, THERE'S A
COUPLE DIFFERENT THINGS TO BE
LOOKED AT.
AS YOU SAID, THERE WAS AN
ALLEGATION OF A BURGLARY WHERE
NECKTIES WERE STOLEN FROM THE
MORRIS LOT AND HOUSEHOLD.
AFTER A DIFFERENT DATE AND TIME,
A GPS WAS ALLEGEDLY STOLEN FROM
HER CAR.
AND BOTH THOSE CASES, NO
PHYSICAL EVIDENCE WAS RECOVERED,
AND THERE WAS INSUFFICIENT
EVIDENCE TO IDENTIFY A SUSPECT
AND THEREFORE BRING A CRIMINAL
CHARGE.
AND SO IN TERMS OF THE PROPERTY
CRIMES, THERE JUST WASN'T ANY
EVIDENCE TO PROSECUTE SOMEBODY.
WE DIDN'T HAVE A SUSPECT.
IN REGARDS TO THE SPEECH, YOU
NOW ARE TALKING ABOUT THE FIRST
AMENDMENT AND IT'S IMPORTANT TO
NOTE THE FIRST AMENDMENT, WHICH
OF COURSE IS FREEDOM OF SPEECH,
IS A VERY HIGH THRESHOLD AND
MOST SPEECH IS PROTECTED SPEECH.
EVEN THINGS THAT ARE HATEFUL,
THAT ARE UNPLEASANT, THAT ARE
CAUSTIC, THAT IS WHAT -- THAT IS
FIRST AMENDMENT IN THIS COUNTRY.
A COUPLE OF EXAMPLES.
CASES WHICH WE CITED IN OUR
FINDINGS.
PRESIDENTIAL CANDIDATE PRESIDENT
OBAMA, SOMEBODY POSTED ONLINE
BASICALLY SAYING I'M GOING TO
PUT A 50-CAL IN HIS HEAD.
THE COURT HAS SAID THAT IS
PROTECTED SPEECH.
ANOTHER CANDIDATE, ELECTED
OFFICIAL, GOVERNOR OF
WASHINGTON, SOMEBODY MADE A
THREAT OF SEXUAL VIOLENCE
AGAINST A CHILD OF THE GOVERNOR
AND SAID THAT SHE SHOULD BE
BURNED AT THE STAKE.
THE COURT SAID THAT WAS
PROTECTED.
SO IT'S A VERY HIGH THRESHOLD
WHEN YOU'RE TALKING ABOUT
PROTECTED SPEECH.
THE ONE EXCEPTION IS WHAT WE
CALL A TRUE THREAT, WHICH IS A
LEGAL TERM, AND IN THIS CASE,
THE HARASSMENT, THE RACIAL
HARASSMENT, WHICH I CONDEMN,
WHICH IS RACIST, WHICH IS
DEMEANING, DEROGATORY, IN THIS
CASE, IT DID NOT RISE TO THE
LEVEL OF THAT TRUE THREAT, WHICH
IS A LEGAL TERM, AND THEREFORE
IT WAS PROTECTED SPEECH.
AND I HAVE TO SAY THIS, DARREN,
THAT IN OUR DEMOCRACY, WE DON'T
THROW OUT THE LAW, WE DON'T
THROW OUT OUR CONSTITUTION
BECAUSE WE'RE IN DIFFICULT TIMES
AND I DON'T THINK THE POLITICAL
CLIMATE SHOULD DICTATE WHO GETS
PROSECUTED AND WHO DOESN'T GET
PROSECUTED.
I THINK THE FIRST AMENDMENT IS
CLEAR.
IT STOOD THE TEST OF TIME.
YES, THESE ARE CHALLENGING
TIMES, THEY'RE EMOTIONAL TIMES.
I CONDEMN THE RACISM, I CONDEMN
THE HATE, BUT WE NEED TO RISE
ABOVE IT AND COME TOGETHER AS A
COMMUNITY AND NOT FORGET WHAT
MADE THIS COUNTRY GREAT IN THE
FIRST PLACE, AND THAT'S OUR
CONSTITUTION.
>> Darren: THE BENNINGTON POLICE
DEPARTMENT WAS CRITICIZED BY
MORRIS AND OTHERS FOR NOT DOING
ENOUGH IN THIS CASE, BUT IT
SOUNDS LIKE WITH YOUR OFFICE,
THE A.G.'S OFFICE, THAT THEY
WERE RIGHT, THAT THERE WASN'T
ENOUGH TO BRING CHARGES.
OR DID THE P.D. NOT DO ENOUGH?
>> Donovan: I THINK THE
BENNINGTON POLICE WAS RESPONSIVE
IN TERMS OF THE CALLS OF DOING
ITS INVESTIGATION.
AS I SAID, THEIR WORK PRODUCT IN
TERMS OF BOTH ALLEGATIONS OF THE
PROPERTY CRIMES WAS CONSISTENT
WITH MOST LAW ENFORCEMENT
AGENCIES IN THIS CASE.
I THINK WHEN YOU TALK ABOUT THE
ISSUE OF RACISM, WHEN YOU TALK
ABOUT THE ISSUE OF BIGOTRY,
SOMETHING IS -- SOMETHING
GREATER IS REQUIRED THAN JUST
OUR NORMAL POLICE WORK, THOUGH.
WE HAVE TO UNDERSTAND AND LISTEN
TO PEOPLE OF COLOR'S EXPERIENCE,
WE HAVE TO VALIDATE THEIR
EXPERIENCE.
WE HAVE TO BELIEVE THEM AND
THERE'S GOT TO BE THAT EMOTIONAL
RESPONSE FROM LAW ENFORCEMENT
THAT PEOPLE FEEL PROTECTED,
PEOPLE WHO HISTORICALLY HAVE
BEEN VICTIMS OF RACISM, HAVE
BEEN PERSECUTED, THIS IS THE
CHALLENGE WE'RE FACING.
AND SO WE HAVE TO COME UP WITH
NEW WAYS OF ADDRESSING THIS
ISSUE, OF MAKING SURE EVERYBODY
FEELS SAFE, OF MAKING SURE THAT
EVERYBODY HAS EQUAL PROTECTION
UNDER THE LAW.
THAT'S WHY WE ANNOUNCED OUR NEW
BIAS INCIDENT REPORTING SYSTEM,
BECAUSE AS I SAID, MOST OF THESE
CRIMES DON'T EVEN GO TO THE
POLICE.
THAT'S GOING TO BE THE FIRST
CALL THE VERMONTER MAKES,
RIGHTFULLY SO, BUT A LOT OF
TIMES, AND WE'VE SEEN THIS TIME
AND TIME AGAIN THROUGH MANY
POLICE AGENCIES, THEY SAY THIS
IS PROTECTED SPEECH AND IT ENDS
THERE.
WHAT WE'RE GOING TO DO IS BRING
IN ALL THE PROSECUTORS, THE
STATES ATTORNEYS THROUGHOUT THE
STATE, WE'RE GOING TO BRING IN
THE CIVIL RIGHTS UNIT, WE'RE
GOING TO MAKE SURE OUR FEDERAL
PARTNERS, THE PROSECUTORS AT THE
U.S. ATTORNEYS ARE INVOLVED AND
WHEN THOSE BIAS INCIDENTS OCCUR,
WE'RE GOING TO MAKE SURE
EVERYBODY IS TAKING A LOOK AT
IT, BECAUSE IT MAY NOT BE A
CRIMINAL PROS KU, BUT IT MAY BE
A CIVIL RIGHTS VIOLATION.
SO WE'RE GOING TO EXPAND THE
FIELD, PUT MORE PLAYERS ON THE
FIELD, SO WE'LL HELP MORE PEOPLE
IN THE STATE TO ADDRESS THE
ISSUES OF HATE, ADDRESS THE
ISSUES OF BIAS, AND PROTECT
PEOPLE.
>> Darren: IN ADDITION TO THAT
NEW SYSTEM, I KNOW THERE'S SOME
FORUMS COMING UP.
WE'LL GET TO THAT IN A MOMENT,
BUT I HAVE A QUESTION.
THERE WAS A PROTECTIVE ORDER
AGAINST THIS GUY WHO INTERRUPTED
THE PRESS CONFERENCE.
THAT WAS PUT IN PLACE TO
PROHIBIT HIM FROM CONTACTING
MORRIS.
HAD THAT EXPIRED?
WHY CAN'T HE BE CHARGED FOR
THAT?
>> Donovan: YEAH, THAT ORDER HAD
EXPIRED, SO THAT IS THE FIRST
ANSWER TO THAT QUESTION.
THE ORDER EXPIRED, IT WAS NO
LONGER IN EFFECT.
I BELIEVE IT WAS YEAR-LONG
ORDER.
SECONDLY, THE PRESS CONFERENCE
IS A PUBLIC MEETING AND THERE
WAS NO REASON TO LEGALLY PREVENT
HIM FROM WALKING IN.
I WILL SAY THIS.
WAS IT EXTREMELY IN POOR TASTE?
ABSOLUTELY.
IS THIS GENTLEMAN TRYING TO
PROVOKE PEOPLE?
ABSOLUTELY, AND I SAID THIS TO A
COUPLE FOLKS.
THE PRESS CONFERENCE FOR THE
FIRST HOUR WAS ACTUALLY QUITE
GOOD.
IT WAS EMOTIONAL, IT WAS
BRUTALLY HONEST.
IT HAD PEOPLE, I THINK, COMING
TOGETHER AND THERE WAS REAL
MOMENTUM.
UNFORTUNATELY, THIS GUY SHOWS
UP.
A WHITE SUPREMACIST SHOWS UP AND
IT REALLY DERAILED THINGS, AND I
WAS TALKING TO KIAH THE MORNING
AFTER AND I SAID, YOU KNOW, WE
WERE SO CLOSE.
AND SHE SAID, YOU KNOW WHAT?
BUT NOW VERMONT GETS TO SEE, AND
I THINK THAT'S TRUE.
THIS IS REALITY.
WE HAVE WHITE SUPREMACISTS IN
THIS STATE.
THEY COME TO PROVOKE, TO A
SYNAGOGUE WEARING A SYMBOL OF
ANTI-SEMITISM.
THEY COME TO PROVOKE AND UPSET
PEOPLE DELIBERATELY, AND OUR
CHALLENGE, AGAIN, IS NOT TO
FORGET OUR RULE OF LAW.
OUR CHALLENGE IS TO RISE ABOVE
IT AS A COMMUNITY, TO ADDRESS
ISSUES OF HATE SPEECH WITH MORE
SPEECH, NOT ABOUT HATE, BUT
ABOUT LOVE, ABOUT COMPASSION,
ABOUT SOLIDARITY, BY MAKING SURE
WE'RE PASSING LAWS AND
INITIATIVES FROM OUR SELECT
BOARDS ALL THE WAY TO OUR STATE
LEGISLATURES TO GIVE PEOPLE
OPPORTUNITY AND HOPE IN THIS
STATE AND MAKING SURE, FINALLY,
BY DEMONSTRATING THAT WE DO, WE
DO FOLLOW OUR RULE OF LAW, EVEN
WHEN IT'S UNPOPULAR, THAT IS THE
TEST OF THIS DEMOCRACY.
THAT IS THE TEST OF THIS TIME
THAT WE'RE IN, WHICH IS AN
INCREDIBLY DIFFICULT, EMOTIONAL
TIME, BUT I DON'T THINK WE CAN
FORGET OUR LAWS BECAUSE THE
SPEECH, DARREN, THAT ALLOWS YOU
TO GET UP AND SAY SOMETHING OR
ALLOWS ANYBODY TO GO ON THE
STREET CORNER AND SAY, I MAY
AGREE WITH AND I'M GOING TO
DEFEND IT, BUT I ALSO HAVE TO
DEFEND SOMEBODY WHOSE SPEECH I
DISAGREE WITH AND MAY BE
UNPOPULAR AS LONG AS THEY DON'T
CROSS THE LINE AND VIOLATE THE
FIRST AMENDMENT.
THAT'S THE CHALLENGE WE'RE
FACING RIGHT NOW.
WE NEED TO COME TOGETHER AS A
STATE AND ADDRESS THIS.
>> Darren: SO LET'S TALK ABOUT
WHERE WE GO FROM HERE THEN.
LAWMAKERS SAY PASSING NEW LAWS
TO PROTECT PEOPLE FROM HURTFUL
SPEECH HAS LEGAL CHALLENGES,
CONSTITUTIONAL RIGHTS INVOLVED
HERE, OF COURSE, BUT IT WILL BE
EXPLORED.
WHAT CAN BE DONE?
>> Donovan: WELL, AS SPEAKER
JOHNSON AND SENATOR DICK SEAR
SAID, THEY'RE GOING TO EXPLORE
THIS ISSUE AND WE'LL BE RIGHT
THERE WITH THEM, MAKING SURE WE
PASS LAWS THAT PROTECT PEOPLE
AND GRANT PEOPLE EQUAL
PROTECTION UNDER THE LAW, AND
REALLY TO STAMP OUT RACISM.
I THINK THE FIRST THING WE HAVE
TO DO WHEN WE TALK ABOUT RACISM,
WE GOT TO BE HONEST ABOUT IT.
IT'S HERE IN VERMONT, IT EXISTS,
AND I THINK PEOPLE LIKE ME, A
WHITE GUY IN A POSITION OF POWER
AND ALL OF US, HAVE TO STOP
BEING DEFENSIVE AND WE HAVE TO
LISTEN, WITH EVER -- WE HAVE TO
LEARN AND WE HAVE TO HAVE SOME
TOUGH CONVERSATIONS AND THAT'S A
BIG STEP IN THE RIGHT DIRECTION.
THAT'S WHY WE'RE DOING THESE
COMMUNITY FORUMS.
IN TERMS OF LEGISLATION, I FULLY
SUPPORT IT, BUT WE GOT TO FIND A
WAY THAT BALANCES PEOPLE'S
CONSTITUTIONAL RIGHTS WHILE
PROTECTING PEOPLE.
I THINK WE CAN DO SOMETHING.
I LOOK FORWARD TO WORKING WITH
THE LEGISLATURE TO ADDRESS THIS
ISSUE, AND THIS IS A TRUE TEST
FOR US.
THIS IS, AS I SAID IN MY SPEECH,
THE GREAT TASK BEFORE US IS TO
ADDRESS THE ISSUE OF RACISM IN
OUR STATE, AND I THINK AS I SAID
BEFORE, THE FIRST THING WE HAVE
TO DO IS ACKNOWLEDGE IT.
IT'S REAL.
IT'S HAPPENING, AND PEOPLE OF
COLOR HAVE BEEN VICTIMS OF IT
FOR FAR TOO LONG AND WE HAVE A
CHOICE.
WE CAN COME TOGETHER AND WE CAN
ADDRESS, THIS OR WE CAN CONTINUE
TO KEEP OUR HEAD IN THE SAND IF
AND PRETEND IT'S NOT HAPPENING.
IT IS HAPPENING.
PEOPLE DESERVE BETTER.
THIS IS SOMETHING WE NEED TO DO,
BUT WE GOT TO DO IT IN A WAY
THAT DEMONSTRATES OUR FIDELITY
TO OUR RULE OF LAW AND TO OUR
SYSTEM OF GOVERNMENT, WHICH IS
BEING CONSISTENT WITH OUR LAW.
EVEN WHEN IT'S UNPOPULAR.
I KNOW THAT'S A HARD THING TO
SAY, BUT I FEEL STRONGLY ABOUT
IT BECAUSE TO THROW OUT OUR
LAWS, TO THROW OUT OUR
INSTITUTIONS IS GOING TO BE A
SETBACK IN THE LONG RUN.
I THINK WE NEED TO RISE ABOVE
THERE TOGETHER AS A COMMUNITY.
>> Darren: ATTORNEY GENERAL T.J.
DONOVAN, THANK YOU VERY MUCH FOR
JOINING US THIS MORNING.
>> Donovan: THANKS FOR HAVING
ME, DARREN.
>> Darren: IT IS TIME NOW TO
CHECK IN WITH SCOTT FLEISHMAN TO
SEE WHAT THEY'RE WORKING ON
COMING UP ON THE CHANNEL 3 NEWS
AT 8:00 A.M.
HEY, SCOTT.
>> Scott: HEY, DARREN.
LET IT SNOW, LET IT SNOW, LET IT
SNOW.
A STORM COMING THROUGH OVERNIGHT
IS GIVING US QUITE THE VIEW TO
WAKE UP TO THIS MORNING.
WE'LL HAVE AN UPDATE ON THE
CONDITIONS AND THE LATEST TOTALS
OUR AREA SHOULD EXPECT.
PLUS, WE LED TO SOUTH BURLINGTON
WITH SOME MIDDLE SCHOOL STUDENTS
LEARNING REAL-LIFE ENTREPRENEUR
SKILLS.
MAYBE SOME FUTURE MADE IN
VERMONT BUSINESS PEOPLE RIGHT
HERE.
WE'LL TELL YOU ABOUT THIS
PROJECT-BASED COURSE AND HEAR
FROM THE STUDENTS INVOLVED.
ALSO, WE'RE LOOKING AHEAD TO
STORIES YOU'LL BE TALKING ABOUT
THIS WEEK.
THE FUSE BEGINS AT THE TOP OF
THE -- NEWS BEGINS AT THE TOP OF
THE HOUR.
>> Darren: TRAIN TRACK
TRAGEDIES.
NEXT, WHAT YOU NEED TO KNOW
ABOUT CHANGES TO INSPECTIONS.
>> Cat: IF THE CHECK ENGINE
LIGHT IS ON AND YOU HAVE A STATE
INSPECTION COMING UP, THERE'S
SOMETHING YOU SHOULD KNOW THAT
YOU DON'T WASTE TIME AND POINT.
I'M CAT VIGLIENZONI WITH THE
CHANGES THE DMV IS MAKING
STARTING THIS WEEK.
THOSE ARE COMING UP ON THE
CHANNEL 3 NEWS.
>> Darren: IMPORTANT NEWS.
IF YOUR CAR HAS ITS CHECK ENGINE
LIGHT ON, IT MEANS SOMETHING IS
WRONG WITH YOUR EMISSIONS SYSTEM
AND NOW IT MEANS YOUR CAR WILL
FAIL ITS INSPECTION.
LAST YEAR, ABOUT 15% OF CARS
DIDN'T PASS THEIR EMISSIONS
TEST, AND WERE GIVEN A TEMPORARY
REPRIEVE, BUT WE'RE LEARNING THE
CLOCK IS TICKING TO BRING THOSE
70,000 CARS INTO COMPLIANCE.
ALL VERMONT DRIVERS GOT THIS
POSTCARD IN THE MAIL LAST WEEK.
IT'S FROM THE DMV, AND IT'S
DESIGNED TO ALERT YOU TO SOME
EXCHANGES.
NEXT TIME YOU BRING YOUR CAR IN
FOR INSPECTION.
CAT VIGLIENZONI FOUND OUT WHAT
THEY ARE AND WHAT YOU NEED TO
DO.
>> I OPENED IT UP, SURPRISE!
>> Cat: LAST WEEK, AUTO
CRAFTSMAN OWNER GOT AN EMAIL
FROM THE VERMONT DEPARTMENT OF
MOTOR VEHICLES THAT SHE WASN'T
QUITE READY FOR.
IT SAID THE CONDITIONAL PASS FOR
CARS THAT DIDN'T MEET EMISSIONS
REQUIREMENT IS WAS ENDING A
JANUARY 15th.
>> THERE WAS A LOT TO TAKE IN.
I WAS A LITTLE DISAPPOINTED IN
THE STATE BECAUSE IT'S LESS --
YOU KNOW, IT'S A WEEK'S NOTICE
TO A VERY BIG CHANGE THAT'S
HAPPENING.
>> Cat: SHE SAYS SHE STILL HAS A
LOT OF QUESTIONS ABOUT WHAT SHE
SHOULD TELL HER CUSTOMERS WHO
COME IN FOR AN INSPECTION WITH
THEIR CHECK ENGINE LIGHT ON.
>> IT'S NOT A QUICK AND EASY
ANSWER.
>> Cat: THE EMAIL TELLS HER
SHE'S SUPPOSED TO DIRECT
CUSTOMERS TO CHECK THEIR
WARRANTS, TO MAKE SURE PEOPLE
DON'T SPEND MONEY THEY DON'T
HAVE TO, AND IF THE EMISSIONS
REPAIRS AREN'T COVERED, TO HELP
THEM WITH A WAIVER IF THEY CAN'T
AFFORD THE FIX.
>> WE DO FEEL THESE ARE CHANGES
YOUR CUSTOMERS ARE GOING TO
UNDERSTAND?
>> NO, THEY TOTALLY AREN'T GOING
TO UNDERSTAND.
I NEED TO UNDERSTAND FIRST.
>> Cat: QUESTIONS FROM SHOPS
LIKE HERS ARE POURING INTO THE
DMV OFFICES JUST DOWN THE ROAD
IN MONTPELIER.
>> I THINK THIS IS GOING TO BE A
LEARNING EXPERIENCE FOR SOME.
>> Cat: THE COMMISSIONER SAYS
THE LEGISLATURE SET THE DATE FOR
THE CONDITIONAL PASS TO END.
HER OFFICE IS NOW TRYING TO WORK
WITH INSPECTION STATIONS TO
PREPARE VERMONTERS SO THEY DON'T
GET CAUGHT OFF GUARD NEXT TIME
THEY BRING THEIR CAR IN.
THERE ARE TWO THINGS SHE WANTS
YOU TO DO.
THE FIRST --
>> TRY TO GET THAT RESOLVED NOW
IF THE LIGHT IS ON.
>> Cat: SHE SAYS FIXING YOUR
EMISSIONS ISSUES BEFOREHAND WILL
HELP YOU AVOID WASTING TIME AND
MONEY ON AN INSPECTION WHERE YOU
WILL ALMOST CERTAINLY FAIL.
THE SECOND THING SHE WANTS YOU
TO DO IS GET YOUR VEHICLE READY.
>> YOUR VEHICLE HAS TO BE READY
TO BE TESTED FOR EMISSIONS.
>> Cat: THIS IS THE TRICKIER
PART.
THERE'S NO WAY FOR YOU TO TELL
IF YOUR VEHICLE IS READY, BUT IF
YOU KNOW YOUR BATTERY HAS BEEN
IT DID CONNECTED RECENTLY OR
YOUR CAR'S COMPUTER MEMORY HAS
BEEN CLEARED DURING A RECENT
REPAIR, YOU NEED TO DRIVE YOUR
CAR FOR A FEW DAYS AT CITY AND
HIGHWAY SPEEDS SO IT CAN
DIAGNOSE THE EMISSIONS SYSTEM
AGAIN.
IN 2018, NEARLY HALF OF THE CARS
THAT DIDN'T PASS THEIR EMISSIONS
TEST DURING INSPECTION WERE
BECAUSE THEY WEREN'T READY.
FIXING YOUR EMISSIONS CAN MEAN
SHELLING OUT $20 FOR A GAS CAP
REPLACEMENT UP TO $1200 FOR A
NEW CATALYTIC CONVERTER.
THE DMV SAYS THE SOONER YOU MAKE
YOUR REPAIRS, THE CHEAPER
THEY'RE LIKELY TO BE, BUT IF
YOURS COSTS MORE THAN $200 AND
ARE NOT COVERED UNDER A
WARRANTY, YOU CAN APPLY FOR A
WAIVER.
>> IT GIVES THEM A YEAR TO FIND
A WAY TO MAKE THOSE REPAIRS.
>> Cat: BACK AT AUTO CRAFTSMAN,
SHE SAYS SHE HOPES NEW
PROCEDURES AND PAPERWORK WON'T
LEAD TO A BOTTLENECK IN HER
SHOP.
>> MY FEAR IS THIS IS GOING TO
BE A HUGE TIME SUCK AS WE FIGURE
IT OUT AND IT'S GOING TO PUSH
EVERYBODY BACK.
WE WON'T BE ABLE TO DO AS MANY
CARS PER DAY.
>> Darren: AND CAT JOINS ME NOW.
GOOD MORNING TO YOU.
>> Cat: GOOD MORNING.
>> Darren: SO EMISSION TESTS,
THEY'RE NOT NEW, RIGHT?
>> Cat: NO, NO, THEY AREN'T.
THIS IS A -- FOR A LOT OF
PEOPLE, THEY SAW THE HEADLINE
AND DIDN'T READ THE STORY.
THEY SAY WAIT A MINUTE, I
REMEMBER GETTING MY CAR TESTED
FOR EMISSIONS FOUR YEARS AGO.
WELL, THEY HAVE BEEN PART OF THE
VERMONT INSPECTION PROCESS SINCE
1996 AND THE ONLY REASON THEY
WERE RELAXED THE PAST COUPLE OF
YEARS WAS TO HELP WITH THE
STATE'S TRANSITION TO A STRICTER
DIGITAL INSPECTION SYSTEM.
NOW THAT'S BEEN DONE, THE STATE
IS GOING BACK TO THE ORIGINAL
REQUIREMENTS.
THE WAIVER PART IS NEW, THOUGH.
>> Darren: LET'S GET INTO THAT.
CAN PEOPLE STILL GET A WAIVER?
>> Cat: THEY CAN, BUT NOT TWO
YEARS IN A ROW.
IT'S ONLY FOR A YEAR AND BY THE
NEXT INSPECTION, YOU NEED TO
HAVE THE FIXES MADE.
YOU CAN'T GET A WAIVER FOR THE
SAME ISSUES TWICE.
>> Darren: WHAT ELSE IS BEING
PUT IN PLACE FOR DRIVERS HERE?
>> Darren: WE HEAR A LOT ABOUT
PEOPLE SAYING I CAN'T AFFORD
THESE FIXES, THEY'RE COSTLY, AND
THE LEGISLATURE IS LISTENING TO
THAT.
WE ACTUALLY HEARD FROM DICK
MAZZA WHO SAID THAT THE
COMMITTEE IS WORKING ON, OKAY,
HOW DO WE HELP VERMONTERS GET
THERE.
SO IT'S SOMETHING THAT THE STATE
HAS TO PUT SOME MONEY IN TO HELP
VERMONTERS MEET THOSE
REQUIREMENTS, DO THEY HAVE TO
THINK ABOUT DIFFERENT WAYS THAT
THE PROCESS MIGHT GO SO THAT
VERMONTERS DON'T HAVE TO MAKE
THOSE REPAIRS IN SOME TIMEFRAME.
THEY'RE STILL TRYING TO KICK
AROUND IDEAS, SO IT'S STILL
UNCLEAR HOW THEY MIGHT HELP YOU
AND HELP VERMONTERS, BUT THEY
ARE DEFINITELY LOOKING AT SOME
POSSIBLE OPTIONS WITHIN THE
COMMITTEES.
BUT I WOULDN'T EXPECT ANYTHING,
YOU KNOW, IMMEDIATELY HERE.
>> Darren: DID YOU HEAR FROM THE
COMMISSIONER ABOUT THE REPORT?
>> Cat: I DID.
AFTER WE DID OUR INTERVIEWS WITH
BOTH AMY AT AUTO CRAFTSMAN AND
THE COMMISSIONER, BOTH OF THEM
GOT BACK TO ME AND SAID THAT
THEY HAD A MEETING, IT WENT
REALLY WELL AND THEY'RE WORKING
ON A FLOW CHART TO HELP AUTO
SHOPS WALK THROUGH THE NEW
PROCESS, HOW TO DO IT PAPERWORK,
WHAT HAPPENS IF A CUSTOMER HAS A
VERY SPECIFIC ISSUE THEY NEED
ADDRESSED SO THEY CAN ADDRESS
SOME OF THOSE ISSUES SO EVERYONE
IS EFFECTIVELY ON THE SAME PAGE.
>> Darren: WHY DID THE STATE
HAVE TO DO THIS EMISSIONS TEST
IN THE FIRST PLACE?
SOME STATES DON'T DO IT AT ALL,
RIGHT?
>> Cat: RIGHT, THEY DON'T.
IT REALLY COMES DOWN TO EPA
REQUIREMENTS.
VERMONT, AS IT WAS EXPLAINED TO
ME, IS REQUIRED BY THE EPA TO
MEET CERTAIN EMISSION
REQUIREMENTS WHEN IT COMES TO
AUTOMOBILES AND BECAUSE OF WHERE
WE ARE IN THE COUNTRY, WE HAVE
DIFFERENT REQUIREMENTS THAN
OTHER PARTS OF THE COUNTRY AND
THAT'S PROBABLY THE SIMPLEST WAY
IT WAS EXPLAINED TO ME.
SO IT'S EFFECTIVELY, THEY SAY WE
HAVE TO DO IT BECAUSE THE FEDS
SAY SO.
>> Darren: A LOT OF FOLKS ARE
PROBABLY SAYING, HEY, MY CAR IS
NOT UNDER WARRANTY.
THIS, AS YOU MENTIONED, AS
PRETTY EXPENSIVE THING.
THEY MIGHT STILL BE COVERED,
THOUGH.
WHAT DO YOU THINK ABOUT THAT?
>> Cat: SO THE FIRST STEP OF
THIS PROCESS IS WHEN YOUR CAR
HAS A CHECK ENGINE LIGHT O
YOU'RE SUPPOSED TO TAKE IT TO
YOUR DEALER AND CALL YOUR DEALER
AND SEE IF THE CAR IS UNDER
WARRANTY.
THE REASON FOR THAT IS VERMONT
FOLLOWS CALIFORNIA EMISSION
STANDARDS, SO EVEN WHEN THE
WARRANTY OF THE CAR RUNS OUT,
SOME PARTS OF THE EMISSION
SYSTEMS ARE STILL COVERED.
SOME CARS, PARTS ARE COVERED UP
TO 15 YEARS, AT LEAST THE MAJOR
COMPONENT, BUT TO CHECK THAT,
YOU NEED TO HAVE THE DEALER RUN
THE VIN RUN THROUGH THE SYSTEM,
THE VEHICLE IDENTIFICATION
NUMBER, AND THE DMV HAS
INFORMATION ONLINE THAT CAN HELP
IN THAT EFFORT, TOO.
WE HAVE A LINK ON OUR STORY ON
OUR WEBSITE THAT HAS MORE
INFORMATION ABOUT READINESS,
WHICH IS PART OF THAT, ABOUT
WARRANTIES AND WHAT YOU MIGHT
NEED TO DO TO GET YOUR CAR RED.
>> Darren: THANKS FOR DIGGING
INTO.
I'M SURE A LOT OF PEOPLE
APPRECIATE THAT, CAT.
THANK YOU SO MUCH.
>> Cat: ABSOLUTELY.
>> Darren: COMING UP NEXT, DON'T
BREAK THE LAW.
WHAT YOU NEED TO KNOW ABOUT
RAILROAD TRACK SAFETY.
>>> TWO POLICE OFFICERS
APPROACHED AND THEN ONE SAID,
ARE YOU NANCY?
AND I SAID YES.
HE SAID ARE YOU KEVIN'S MOM?
AND I JUST DIDN'T EXPECT TO HEAR
THAT AT ALL.
AND I SAID YES.
AND THEY SAID, KEVIN'S BEEN HIT
BY A TRAIN AND HE'S DEAD.
>> Darren: THAT'S A MOM WHOSE
SON DIED WHILE WALKING ON
RAILROAD TRACKS.
HE HAD EAR BUDS IN AND DIDN'T
HEAR THE TRAIN COMING.
HE WAS WALKING TO WORK AND TOOK
THE TRACKS TO GET THERE FASTER.
THIS MORNING, WE ARE TALKING
ABOUT OPERATION LIFESAVER WHICH
PROMOTES RAIL SAFETY EDUCATION
WITH MY GUEST ALAN FRANKLIN.
GOOD MORNING TO YOU.
>> Franklin: GOOD MORNING.
>> Darren: EXPLAIN WHAT THIS
PROGRAM DOES.
>> Franklin: OPERATION LIFESAVER
AS NONPROFIT RAIL SAFETY AND
AWARENESS -- EDUCATION AND
AWARENESS PROGRAM AND WE STRIVE,
WE DO PRESENTATIONS TO SPREAD
THE RAIL SAFETY MESSAGE.
>> Darren: I LEARNED SOMETHING
RECENTLY.
I WAS ACTUALLY SHOOTING WHAT WE
CALL IN THE BUSINESS A STAND-UP.
I WAS POINTING OUT ON RAILROAD
TRACKS WHERE A PRETTY HORRIFIC
CRIME HAD TAKEN PLACE ON THE
TRACKS.
I DIDN'T KNOW, BUT I WAS
TRESPASSING, RIGHT?
>> Franklin: THAT'S CORRECT.
THE RAILROAD TRACKS ARE NOT
PUBLIC RIGHTS-OF-WAY.
THEY BELONG TO THE RAILROADS,
AND THEY ARE FOR THE TRAINS AND
THE TRAINS ONLY.
>> Darren: SO SOME OF THE MOST
COMMON WAYS THAT PEOPLE REALLY
BREAK THE LAW HERE IS WALKING ON
THE TRACKS, RIGHT?
>> Franklin: THAT'S CORRECT.
WALKING, USING IT AS A SHORTCUT,
CROSSING, YOU KNOW, WHERE
THERE'S NOT A CROSSING, IT'S ALL
IN THE TRESPASSING.
YOU CAN BE SUBJECT TO A $200
FINE OR IN SOME CASES ARREST AND
CITATION.
>> Darren: LET'S TALK ABOUT THE
DANGERS OF WALKING ON THE
TRACKS, ESPECIALLY AS WE HEARD
FROM THAT MOM, IF YOU'RE
DISTRACTED.
>> Franklin: THAT'S CORRECT.
FIRST OFF, TRAINS CANNOT STOP
QUICKLY.
FREIGHT TRAINS CAN TAKE UP TO A
MILE OR MORE TO COME TO A
COMPLETE STOP.
VERY OFTEN, YOU CANNOT HEAR THE
TRAIN, PARTICULARLY IF YOU'RE
WEARING EAR BUDS OR ANY KIND OF
DISTRACTION SUCH AS THAT.
TRAINS CAN'T SLOW UP TO AVOID
YOU AND THE FORCE OF A TRAIN
HITTING A CAR IS ABOUT THE SAME
AS A CAR RUNG OVER A SODA CAN.
THE FACT THEY CAN'T SWERVE, THEY
CAN'T STOP QUICKLY, AND THE
POWER MAKES IT A DEADLY
COMBINATION.
>> Darren: LET'S TALK QUICKLY
EMPLOY WHAT DRIVERS ARE DOING
WRONG -- QUICKLY ABOUT WHAT
DRIVERS ARE DOING WRONG.
SOMETIMES THEY'RE GOING AROUND
THE GATES, RIGHT?
>> Franklin: THAT'S PROBABLY THE
ONE MOST OBVIOUS DANGER TO
AVOID.
WHEN THOSE GATES ARE DOWN AND
THE LIGHTS ARE FLASHING, A TRAIN
IS COMING.
DO NOT TRY TO BEAT THE TRAIN
BECAUSE IT'S AN OPTICAL ILLUSION
EFFECT.
YOU CANNOT JUDGE THE SPEED OF
THE TRAIN, SO DON'T TRY IT.
>> Darren: DON'T TRY IT.
AND VERY QUICKLY, I THINK WE
HAVE ONE MORE GRAPHIC AND THERE
IS JUST A PHONE NUMBER THAT IS
PUT UP AT MOST RAILROAD
CROSSINGS, I BELIEVE, AND THIS
IS IF THERE'S AN EMERGENCY,
RIGHT?
>> Franklin: THAT'S CORRECT,
DARREN.
IF YOU FIND YOURSELF STUCK ON
THE TRACKS, IF YOU HAVE TIME,
GET OUT OF THE CAR, GET ALL THE
PASSENGERS OUT OF THE CAR AND
CALL THE NUMBER ON THE SIGN.
THERE'S TWO NUMBERS, A PHONE
NUMBER THAT GETS YOU AHOLD OF A
DISPATCHER THAT CAN STOP ANY
TRAIN TRAFFIC IN THE AREA AND
THE OTHER NUMBER IS THE SPECIFIC
CROSSING NUMBER OF EVERY
RAILROAD CROSSING IN AMERICA,
AND THAT PINPOINTS WHERE THERE
MIGHT BE AN ISSUE.
IF THERE IS A TRAIN COMING, GET
OUT.
AGAIN, RUN AWAY FROM THE TRACKS
IN THE DIRECTION THE TRAIN IS
COMING SO YOU WOULD NOT BE HIT
BY ANY DEBRIS.
>> Darren: THANK YOU SO MUCH.
I LEARNED SOMETHING AND I HOPE
FOLKS DID AT HOME TOO.
THANK YOU FOR WATCHING AND HAVE
A GREAT DAY.
